Your rights as a data subject

First of all, we would like to take this opportunity to inform you of your rights as a data subject. These rights are standardized in articles 15 - 22 of the EU-GDPR. They include:

•    Right of access (Art. 15 EU-GDPR),
•    Right to erasure (Art. 17 EU-GDPR),
•    Right to rectification (Art. 16 EU GDPR),
•    Right to data portability (Art. 20 EU-GDPR),
•    Right to restriction of processing (Art. 18 EU-GDPR),
•    Right to object to data processing (Art. 21 EU-GDPR).

To assert these rights, please contact: datenschutz@warema.de. The same applies if you have questions about data processing in our company or would like to revoke any consent you have previously granted. You also have the right to lodge a complaint with a data protection authority.

Right to object

Please note the following concerning your right to object:

If we process your personal data for the purpose of direct advertising, you have the right to object to this data processing at any time without giving reasons. This applies also to any profiling, insofar as it is associated with direct advertising.

If you object to processing for direct advertising purposes, we will no longer use your personal data for such purposes. The objection can be submitted free of charge, in any form and should preferably be sent to: datenschutz@warema.de.

In the event that we process your data in order to protect our legitimate interests, you can object to this processing at any time for reasons relating to your particular situation; this applies also to any profiling based on these provisions.

We will then no longer process your personal data unless we can demonstrate compelling legitimate grounds for processing that override your interests, rights and freedoms, or if such processing serves to establish, exercise or defend legal claims.

Purposes and legal grounds of data processing

The regulations of the EU-GDPR and all other applicable regulations from data protection law are observed in the processing of your personal data. The legal grounds for data processing ensue in particular from Art. 6 of the EU-GDPR.

We use your data to take up initial business contact with you, to meet contractual and legal obligations, to execute the contractual relationship, to offer products and services and to improve relations with customers, which may also include analyses for marketing purposes and direct advertising.

Your consent to data processing may also constitute a legal data protection permission instruction. Before granting consent, we shall clarify the purpose of data processing and your right of revocation.

Transfer to third parties

We will transfer your data to third parties only within the scope of the legal regulations or if you have granted your consent thereto. Transfer to third parties shall otherwise not take place unless we are obliged by mandatory legal provisions (transfer to external bodies such as supervisory authorities or law enforcement authorities).

Recipients of data / Categories of recipients

Within our company, we ensure that your data is made available only to those who require it to fulfil contractual and legal obligations. Any applications you submit shall be forwarded to the company to which you have specifically applied. Should you apply to our Hungarian company, your application will be forwarded to Hungary for further processing and if necessary you will be contacted.

In certain cases, service providers (IT service providers) help our specialist departments accomplish their tasks. The agreements required under data protection law are concluded with all service providers.

Transmission to third countries / Intention to transmit to third countries

Data shall be transmitted to third countries (outside of the European Union or European Economic Area) only if this is required to fulfil a legal obligation, is mandated by law or if you have granted your consent thereto.

We do not currently share your personal data with service providers or group companies outside of the European Economic Area.

Duration of data storage

We store your data for as long as is required for the particular processing purpose. Please note that many retention periods require data to be stored for longer. This applies in particular to commercial and fiscal retention obligations (e.g. German Commercial Code, Tax Code, etc.). In the absence of any further retention obligations, the data is routinely deleted after its purpose has been achieved.

We can also store data if you have granted us your consent to do so or if legal disputes arise and we make use of evidence within statutory limitation periods, which can be up to thirty years; the usual limitation period is three years.

Secure transmission of your data

In order to best protect the data saved in our system against accidental or intentional tampering, loss, destruction or access by authorised persons, we use appropriate technical and organisation security measures. The security levels are both continuously monitored in collaboration with security experts and adapted to meet new security standards.

The data exchange from and to our website is encrypted in both directions. We offer HTTPS as the transmission protocol for our website, while using the current encryption protocols in each instance. In addition, we offer our users content encryption in the contact forms. Only we are able to decrypt this data. (expand/adapt as required). It is also possible to use alternative methods of communication (e.g. post).

Obligation to provide data

Various personal data is required to establish, execute and terminate the contractual relationship and to fulfil the associated contractual and legal obligations. The same applies to the use of our website and the various functions it provides.

The details of this are summarised in the above item. In certain cases, data must also be collected and/or made available on the basis of legal regulations. Please note that the processing of your request and the execution of the underlying contractual relationship is not possible unless this data is provided.

Categories, sources and origin of data

The data we process is determined by the context concerned. This depends on whether, for example, you place an order online, enter an enquiry into our contact form or submit a complaint.

Please note that we make information available for special processing situations and if necessary also in a suitable location, e.g. when uploading application documents or as part of a contact request.

Cookies (Art. 6, para. 1, lit. a, f EU-GDPR)

Our website uses cookies in several places. Cookies serve to make our content more user-friendly, effective and secure. They are small text files that are placed and saved on your device.
By using cookies, we are also able to analyse the way in which visitors use our websites. This allows us to design website content to suit visitors' needs. Cookies also enable us to measure the efficacy of a certain display and potentially rearrange it depending on the thematic interests of the users. The legal basis for this is Art. 6, para. 1, lit. f or, if consent is granted, Art. 6, para. 1, lit. a EU-GDPR.

We make use of the following cookies:

Our own cookies:
This kind of cookie is controlled directly by WAREMA Kunststofftechnik und Maschinenbau GmbH. Depending on their purpose, they may be permanently saved – even after the browser session ends – (referred to as persistent cookies, e.g. implementation of opt-out) or are deleted when the browser session is ended (so-called session cookies; they are valid only for one browser session). In particular, this concerns the consent script, which declares whether or not you have granted us your consent on our consent banner.

Third-party cookies:
This type of cookie is controlled by third parties. Third-party providers are providers that collect and/or evaluate data on behalf of WAREMA Kunststofftechnik und Maschinenbau GmbH.
This is done using temporary/permanent cookies that are automatically deleted after the specified time. These temporary or permanent cookies are saved on your device and delete themselves after the specified time. Even the cookies used by our partner companies contain only pseudonymous or even anonymous data. These cookies allow our partners to understand which pages you viewed while on our site, which devices you use, the approximate region you are from or how you found out about our site (through ads or campaigns, for example) and so on. Some of our partners also collect, beyond the website visits, information about which pages you visited beforehand or which products interested you. At no time do we associate these pseudonymous data with your personal data.

Most web browsers accept cookies automatically. You can of course manually deactivate, limit or delete cookies on your device in your browser or software settings.

Please note: If you deactivate cookies, you may not be able to use all the functions of our website.

Consent management by Usercentrics (Art. 6, para. I, lit f EU-GDPR)

This website uses Cookie Consent Technology from Usercentrics to obtain your consent to save specific cookies on your device and to document this in compliance with data protection regulations. This technology is provided by Usercentrics GmbH, Rosental 4, 80331 Munich, website: usercentrics.com/de/ (referred to below as "Usercentrics").

The purpose of data processing is to analyse and manage any consent granted in order to meet our obligation to manage consent in compliance with the GDPR. The use of Usercentrics serves as proof of granted and non-granted consent, as well as the management thereof.

Art. 6, para. 1, lit. f GDPR is the legal basis to refer to when managing your consent to the processing of your personal data. Our legitimate interest is in the legally compliant documentation and verifiability of consent, the control of marketing measures on the basis of the granted consent, as well as the optimisation of consent rates.

The following data is processed:
•    Your consent or revocation of your consent
•    Your IP address
•    Information about your browser
•    Information about your device
•    Time of your visit to the website

The consent ID (containing the aforementioned data) and the consent status, incl. time stamp, are stored in the local memory of your browser and on the cloud servers used at the same time. Further processing takes place only if you put in a request for information or withdraw your consent. In this case, we shall provide the relevant information in a compact data format with a plain text format for the purpose of data exchange (JSON file).
No user information is stored about the statistics on the use of the granted or non-granted consent. Only the frequency and locations of the clicks are saved. The personal data are stored on a Google cloud server based in the EU (Brussels, Frankfurt am Main).

The data is erased as soon as it is no longer required. The cookie concerned has a lifespan of 60 days. The revocation document of previously granted consent is retained for three years. The retention period is based on our accountability in accordance with Art. 5, para. 2 GDPR. This obligates that the processing of personal data comply with the General Data Protection Regulation. On the other hand, retention under the usual limitation period pursuant to Section 195 of the German Civil Code (BGB) is three years.

We have concluded a contract for order processing with Usercentrics. This is a contract prescribed by data protection law which guarantees that Usercentrics processes the personal data of our website visitors only in accordance with our instructions and in compliance with the EU-GDPR.

Google Analytics (Art. 6, para. 1, lit. a EU-GDPR)

On our website, we use the Google Analytics tracking tool from Google Ireland Limited. This tool detects and systematically analyses how you as a user interact with our website.
The following items of your personal data are saved in this process:
•    The first three bytes of your IP address
•    A Google-Analytics ID assigned to you
•    The visited website
•    The referrer (the website from which you accessed the visited website)
•    The other visited sub-pages
•    The time you spent on the website
•    The frequency at which you visited the website
•    Browser type used
•    Language settings used
•    Device and operating system used

Google Analytics uses "cookies", text files that are saved on your computer to help the website analyse how visitors use the site. The information generated by the cookie about your use of the website will be transmitted to and stored by Google on servers in the United States.

Because this website has activated the IP anonymisation function, Google will truncate your IP address within member states of the European Union or in other states party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be set to a Google server in the USA and be truncated there. On behalf of this website's operator, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and rendering other services relating to website activity and internet usage to the website operator. By evaluating the data obtained here, we can optimise our content and increase user-friendliness. Google will not associate the IP address transmitted from your browser within Google Analytics with any other data held by Google.

We delete and/or anonymise the data collected by Google Analytics as soon as they are no longer required for our purposes. This occurs after 14 months.

The legal basis for processing your personal data is your consent pursuant to Art. 6, para. 1, lit. a EU-GDPR. You can revoke your consent at any time here [https://usercentrics.com/de/].

Google Tag Manager

Our website uses Google Tag Manager. Google Tag Manager allows website tags to be managed on one platform. The Google Tag Manager tool itself is a cookie-free domain. This means no cookies are saved and no personal data is collected. The tool triggers other tags, which in turn may collect data. Google Tag Manager does not access this data. If a deactivation has taken place, whether at domain or cookie level, this will apply for all tracking tags, as long as these are implemented with Google Tag Manager.

Use of Google reCaptcha (Art. 6, para. 1, sentence 1, lit. f EU-GDPR)

We use Google reCaptcha to determine whether a human being or a computer has entered certain information into our registration form. The provider for this service is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google").

Google uses the following data to determine whether you are a human being or a computer: IP address of the device used, which of our webpages you visit and on which Captcha is integrated, the date and duration of your visit, the recognition data of the browser and operating system type used, the Google account if you are logged in, mouse movements on the reCaptcha areas.

The legal basis for the described data processing is Art. 6, para. 1, lit. f of the EU-GDPR. We have a prevailing legitimate interest in using this tool to ensure the security of our websites, to protect ourselves from automated entries (such as bot attacks) and to ensure that it is used exclusively for private, non-commercial purposes by human users.

Additional information on Google reCaptcha, as well as the Google Data Privacy Statement, can be found at the following links: www.google.com/intl/de/policies/privacy/ and

https://www.google.com/recaptcha/intro/android.html.

Usage of Videos from YouTube

Our website uses plugins for YouTube, a website operated by Google. The operator of the webpages is YouTube, LLC, 901 Cherry Ave. San Bruno, CA 94066, USA. If you visit one of our pages, which is equipped with a YouTube plugin, a connection with the YouTube servers is established. In this case, which of our webpages you have visited is communicated to the YouTube server.

If you are logged into your YouTube account, you enable YouTube to assign your surfing habits directly to your personal profile. You can prevent this by logging out of your YouTube account.

You can find more information about the handling of user data in YouTube's data privacy statement at: www.google.com/intl/en/policies/privacy

Contact form / Contact via e-mail (Art. 6, para. 1, lit. a, b EU-GDPR)

Our website offers a contact form for contacting us electronically. If you write to us via the contact form, we will process your data given in the contact form in order to establish contact you and answer your questions and requests.

This respects the principle of data economy and data avoidance, as you need only give the data absolutely necessary to make contact with you. This includes your e-mail address, your name and the message content itself. In addition, your IP address is processed out of technical necessity and for legal protection. All other data constitute voluntary fields and can be entered optionally (e.g. for a more precise answer to your questions).

In order to ensure the security and confidentiality of your data to the greatest possible extent, we implement the relevant security measures. Your enquiry is sent to us encrypted.

If you contact us via e-mail, we will process the personal data shared in the e-mail only for the purpose of processing your enquiry.

The mandatory fields are marked with a *(star). In addition, your IP address is processed to satisfy technical requirements and statutory legislation.

Unfortunately, we are unable to review your application documents without this information. Unless it is provided, our application system will not allow the application documents to be uploaded. You are, of course, at liberty to provide us with other optional information as part of the application form.

This system has also been used to conclude the agreements required under data protection law. The applications for job vacancies in Hungary are exceptions. You do, however, have the option of our storing your application documents for a longer period (usually 12 months) and comparing them to other vacancies that match your profile.

This is subject to your consent, which you will confirm with us by email upon request. You can withdraw your application from the system at any time, after which you will no longer be considered for the process.
